General Terms and Conditions
(The following GTC contain legal information on your rights according to regulations of the distance selling act and electronic trading.)

1. Area of Application

These General Terms and Conditions (GTC) are applicable to all deliveries from Michelle's Specialities Michelle Tame (following Michelle's Specialities) to consumers (§ 13 BGB).

2. Contract Partners

3. Range and Conclusion of Contract

3.1 The presentation of products in our online shop is not a legally binding offer but an invitation to order. All offers are valid "while stocks last", if not noted otherwise. Errors excepted.

3.2 By clicking the "Complete Order" button you place a binding order for the products listed on the order page. The purchase contract is concluded when we accept your order with an order confirmation via e-mail immediately after receiving your order.

4. Right of Withdrawal

4.1 Consumers according to $ 13 BGB have the following legal right of revocation.

You may revoke this contract within 14 days, without giving any reasons, in writing (e.g. by letter, fax or email), or, if you have received the goods before the revocation period has lapsed, by sending back the goods. The revocation period begins at the earliest when you receive this information on your right of revocation, but not earlier than when receiver has obtained the goods (in the case of recurring deliveries of similar goods not before the first partial delivery has been made), and not before our obligation to inform you in accordance with article 246 § 2 in connection with § 1 section 1 and 2 EGBGB as been fulfilled as well as our obligations in accordance with § 312g paragraph 1 sentence 1 German Civil Code in connexion with article 246 § 3 EGBGB. For keeping within the revocation period it is sufficient that you send off the revocation statement, or the goods themselves, within said period. Consequences of revocation

In the case of an effective revocation, any service already performed, or item already handed over, is to be returned. Any benefit drawn from such service or item, such as interest rates, is to be returned. Don't you can give us respectively return back the performance received and benefits (eg advantages) or only in deteriorated condition or in part, you are obliged to compensate for lost value. You must only pay compensation for the deterioration and derived benefits if the uses or the deterioration is caused by handling with the object more than the testing the properties and functioning. By "testing the properties and functioning" refers to the testing and evaluation of the respective goods, such as it is possible and usual in our store. Items which are suitable for mailing in a package are to be returned. The risk during transit is ours. If the price of the goods to be sent back is not higher than 40 Euro, you are obliged to pay for the regular shipment cost incurred by the returned goods. You are also obliged to pay for the regular shipment cost incurred by the goods to be returned, if at the time of revocation you have not yet given full consideration or made a partial payment for said goods. In all other cases, shipping is paid by the receiver. If item is not suitable to be mailed as a package, it will be picked up from you. Any obligation to reimburse an amount must be fulfilled within a period of 30 days. The period begins at the time of mailing off your declaration of revocation or the goods themselves.

4.2 According to § 312b para 3 No 5 BGB food, beverages and other household items of daily use are excluded from the right of revocation. The right of revocation also does not apply to goods that were produced to customer specifications or clearly tailored to personal needs or for delivery of audio or video recordings or software if the delivered data carriers have been unsealed by you.

4.3 Please avoid damage and contamination. If possible, return the goods to us in original packaging with all accessories and with all packaging components. If neccessary, please use protective packaging. If you no longer have the original packaging, please provide a suitable packaging to protect the goods from damage.

4.4 Please return the goods to us as an insured parcel, and keep the receipt of admittance. On request, we will reimburse you the cost of postage in advance, unless these are to be borne by you.

4.5 Before returning goods, please call us under the phone number 05703 5219700. This will help us to allocate the goods.

4.6 Please note that the information in paragraphs 4.3 to 4.5 are not prerequisite for the effective exercise of the right to cancel.

5. Pricing and Delivery Charges

5.1 The pices stated on the product pages include additional price components. Beside the product price you can see whether the VAT is included or excluded.

5.2 Additionaly to the prices mentioned, we will charge you for delivery costs. These delivery costs depend on the country of destination, selected delivery method and the contents of your order. Possible delivery methods including conditions and costs can be found in our delivery information, which can be reached from the product pages and trolley system. Some products may cause a surchage to the delivery costs. These surcharges are mentioned on the product page and in the trolley system. The total delivery costs will be shown clearly in the shopping trolley system and also on the order page before you send off your order.

5.3 The buyer is obliged to transmit a complete and correct delivery address. If he doesn't, the parcel may be sent back by DHL which causes extra costs (momentarily: 4 Euros). We reserve the right to invoice the buyer with the cost of return and re-sending.

5.4 Orders sent cash on delivery are subject to additional surcharges payable to the deliverer. Momentarily, we do not undertake cash on delivery orders.

6. Delivery

6.1 Normal lead time for goods which are on stock is 2–6 working days (for orders payable cash in advance 2–6 working days after receipt of payment. Possible different lead times are stated on the respective product page and during order process. The stated lead time is not binding, as stock shortages may occur due to expired or defective goods etc.

6.2 Should you not have received your order after 8 working days, please contact us by email. We shall normally offer you a solution within 24 hours.

7. Payment

7.1 Payment can be effected by cash in advance, credit card or PayPal. A different payment method can be arranged for corporate customers and regular customers.

7.2 Should you choose cash in advance, we will state our bank details in the order confirmation. The goods are delivered after receipt of your payment.

7.3 The right of offsetting is available only if the counterclaims have been legally established in court or accepted by us in writing.

7.4 Right of retention is only effectable, if the claim results out of the same contract.

8. Reservation of Ownership

The goods remain our property until receipt of full payment.

9. Warranty

The warranty is subject to legal requirements. For shortcomings occuring during the statutory warranty period of two years from delivery you have the legal right to remedy (at your choice: removal of defects or replacement), and – in the legal requirements – the legal right of reduction or cancellation as well as compensation. You must allow us a total of two amendment attempts. If the desired type of performance is only possible with disproportionate costs, your claim is limited to the other type of remedy.
